This document contains the terms and conditions governing your use of www.artbar.com.au (“this Website”) and your purchase of any sessions, tickets, goods or services from Balic Taylor Pty Ltd ABN 73 682 371 164 trading as (“Artbar”) using this Website.
1. Application of these terms and conditions
1.1 You agree that your use of this Website and the purchase of any sessions, goods or services will be governed by these terms and conditions (“Terms of Use”).
1.2 Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Use. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or make any bookings.
2. Purchases and GST
2.2 Prices quoted on this Website are in Australian dollars and include GST where applicable.
3. Registration
You may be asked to provide personal information, as that term is defined in the Privacy Act 1988 (Cth) (“Personal Information”) to ArtBar before purchasing any session ticket, goods or services from this Website.
All Personal Information Artbar collects from this Website will be maintained in accordance with ArtBar’s Privacy Policy.
ArtBar will use its reasonable endeavours to maintain the security of any Personal Information that you provide. This Website has security measures in place to protect the loss, misuse and alteration of the information under ArtBar’s control. However, no data transmission over the Internet can be completely secure, and ArtBar cannot give an absolute assurance that the information you provide to us will be secure at all times.
4. Sessions Tickets
4.1 Session tickets purchased via this Website are non-refundable and are not available for exchange, unless required by law.
However, with enough notice, we can try to transfer your ticket to another session.
Requests for transferal of tickets can only be made once

You are over the age of 18 years as we are a licenced premise.
We will endeavour to seat you with your friends, however by purchasing session tickets via this Website and you agree that:
You will accept the seat allocated by ArtBar to each ticket purchased; and
ArtBar has made no warranties or representations to you that you will be seated in a particular seat or next to a particular person unless agreed
5. Group Bookings, Events, Pop-ups
Minimum numbers are required for Group bookings, events, pop-ups, please make contact with
info@artbar.com.au for more details
5.2 Deposits
Depending on the event, a $700 non-refundable deposit is required to secure the date and time for your event.
5.3 Final payment
Final payment must be made no less than 14 days prior to your booking, event or pop-up date.
6. Cancellation Policy
If you need to cancel or change your session booking, you can submit a request to info@artbar.com.au
A full refund is available for cancellations made up to 72 hours’ notice of the session start time.
If we receive your request within 24-72hrs of your session start time , you will receive a $30.00 credit voucher for your booking fee. You can use this credit to book another session, based on availability.
No refunds or credit vouchers are applicable for any cancellation or changes made within 24hours of the session start time.
Food platters are not refundable if the session is cancelled within 24 hours of the start of the session.
If you do not show up for the session for any reason, no refunds or credit vouchers are applicable.
* Please note, 7-day notice is required for group bookings of 4 to 9 people and 14-days’ notice is required for group bookings of 10+ people.
7. Conditions of Entry
You must be over 18 years of age and agree to show and produce proof of age upon entry if requested.
Please make sure recording devices stay at home.
Because we are licenced, you cannot bring or consume your own drinks or food.
Keep your mobile on silent or switched off, there will be allocated times to take photos while the class is running.
It is important to arrive on time as the class will start and finish on-time.
Please be considerate to the neighbours before, during and after your session.
We may ask you to shift seats to ensure the session runs smoothly.
We also reserve the right to refuse or end admission to any visitor.
Keep an eye on your belongings – we can take no responsibility for personal items left on the premises during or after your session.
Art is fun for everyone, we hope you enjoy your time with us!
8. Intellectual Property Rights
8.1 You acknowledge and agree that the copyright and other intellectual property rights in this Website and in all information and materials on this Website (“Website Content”) are owned by ArtBar, its affiliates, suppliers or licensors unless expressly indicated. The Website Content is protected by Australian and international copyright and trademark laws.
8.2 You agree that you will not do any of the following without ArtBar’s written permission:
reproduce, copy, modify, merge, change, translate, re publish, frame, upload to a third party, post, transmit, broadcast, communicate to the public or otherwise make the Website Content available to the public; or
8.3 Anything else which would infringe ArtBar’s rights or the rights of ArtBar’s content suppliers.
9. Photos / Videos
9.1
Our artists could be taking photos or videos throughout the classes for use on our social media, website and other promotional purposes. If you do not wish to be in any of the photos just let one of our artists know on the day and we will make sure to leave you out of them!
10. Cancellations by ArtBar
10.1 Coronavirus (COVID-19) or other unforeseen circumstances
10.2 Should ArtBar have to cancel an event due to Coronavirus (COVID-19), or for any other; reason which is out of our control, we will issue you with a full refund or credit voucher for you to use for another available session.
Note: At times, we may be required to reschedule a session based on low booking numbers.
11. Disclaimer
11.1 Except as provided by law, neither ArtBar nor its affiliates nor the employees, officers and agents of ArtBar or its affiliates will be under any liability to you, in contract, tort or otherwise, in respect of any loss or damage (including consequential loss or damage, loss of profits, economic loss or loss of information) which may be suffered or incurred or which may arise directly or indirectly in respect of:
11.1.1 Your use of this Website;
11.1.2 The accuracy, completeness or usefulness of any Website Content or information contained in that Website Content;
11.1.3 Your use of any websites that this Website links to;
11.1.4 Any session tickets or other goods or services supplied pursuant to these Terms of Use; or
11.1.5 In respect of the failure of session to comply with its obligations under these Terms of Use.
12. Gift Vouchers
12.1 A gift voucher is valid for the redemption of 1 session ticket unless otherwise stated
12.2 Gift vouchers bookings are subject to availability (refer website sessions bookings)
12.3 A gift voucher cannot be redeemed for cash, must not be on-sold without the written permission of ArtBar, is non-refundable and is not available for exchange, unless required by law.
12.4 Expiry dates on all ArtBar sessions cannot be extended or changed and is redeemable for 12 months from the date of purchase.
